Position Overview
This position plays a key role in supporting the hospital’s legal operations by overseeing day-to-day legal task, ensuring compliance with Indonesian healthcare laws, assisting with contract management, and addressing legal issues related to patients, employees, and third parties. This role bridges operational activities and legal oversight under the guidance of Manager of Manager Administration and Human Resource.
Key Outcomes:
Legal readiness for commissioning and licensing
All permits, licenses, and approval required for hospital construction and commissioning are obtained on time, including:
IMB (building permit)/PBG
SIPR (Surat Izin Penyelenggara Rumah Sakit)
AMDA/UKL-UPL (environmental compliance)
TDUP, OSS NIB registration via BKPM
Hospital compliance with local zoning, environmental, and land ownership laws
Contractual and vendor agreements secured legally
Drafting, reviewing, and finalizing contracts with construction firms, medial equipment suppliers, IT vendor, and service providers
Ensuring proper risk allocation, warranties, penalties, and regulatory clauses are included
Hospital governance and legal framework established.
Preparation of hospital bylaws, internal legal SOPs, ethic policies, and organizational governance aligned with:
UU No. 4/2009 tentang Rumah Sakit
Peraturan Menteri Kesehatan
Assistance in board legal compliance and legal structuring
Staff legal onboarding & employment contracts ready
Employee contracts for medial and non-medical staff reviewed and issued per Indonesian Manpower Law ( UU No. 13/2003 and Omnibus law)
Policies on discipline, termination, confidentiality, and data protection are implemented
Legal compliance for medical operations and licensing
Assistance in obtaining and maintaining:
SIP (Surat Izin Praktik) for doctors
STR (Surat Tanda Registrasi) for healthcare professionals
Pharmaceutical and radiology permit
Oversight on compliance with BPJS partnership requirement and Ministry of Health Standards
Risk & liability framework in place before launch
Legal risk assessment conducted for hospital operations, including patient safety, medical malpractice and insurance coverage
Contracts with malpractice insurance providers and SOPs for incident response and consent
Patient legal documentation and compliance systems ready
Review and implementation of:
Informed consent forms
Data privacy compliance (based on UU PDP no. 27/2022)
Patient rights policies (aligned with Permenkes No. 69/2014)
System in place for managing patient complaints legally and ethically
Internal legal monitoring mechanism implemented
Tools and workflows developed to ensure ongoing monitoring of compliance, licensing renewals, contract deadlines, and reporting obligations
Legal dashboard or tracking system for hospital management
Primary Duties And Responsibilities
Legal support for licensing and hospital establishment
Coordinate legal documentation required for hospital establishment
Liaise with relevant government agencies to secure all necessary permits and licenses
Ensure legal compliance with national regulations such as:
UU No. 36/2009 (Health law)
UU No. 11/2009 (Hospital law)
UU No. 11/2020 (Job creation Law/Omnibus law)
Environmental regulation (UKL/UPL or AMDAL)
Contract drafting and management
Draft, review, and monitor contracts related to:
Construction and infrastructure vendors
Medical equipment procurement
IT and service providers
Consultant and project managers
Ensure all contracts are legally sound, include proper risk allocation, and comply with Indonesian contract law (KUHPerdata)
Internal legal framework and governance setup
Assist in developing hospital bylaws, legal SOPs, and organizational governance documents
Support creation of internal policies related to legal, compliance, ethics, and patient care
Ensure hospital organizational structure meet legal requirements limited liability company (Perusahaan Terbatas)
Medical staff licensing and employment legalities.
Ensure all healthcare professionals (doctors, nurses, pharmacists) have valid:
SIP (Surat Izin Praktik)
STR (Surat Tanda Registrasi)
Review employment contracts and HR policies to comply with:
UU Ketenagakerjaan (Labor law)
Omnibus law updates
Company regulations and internal policies
Handle legal aspects of staff onboarding, dispute prevention, and contract termination if needed
Legal risk management and insurance
Conduct legal risk assessment prior to hospital opening
Set up legal risk mitigation strategies related to:
Medical malpractice
Patient safety incidents
Third-party liabilities
Assist in procurement and review of insurance
Compliance with patient care regulations
Draft and implemented legal documents and policies for:
Informed consent
Patient rights (as per Permenkes No. 69/2014)
Data privacy (as per UU No. 27/2022 – Personal Data Protection Law)
Coordinate legal aspects of compliant handling mechanism and ethical review boards
Coordination with external stakeholders
Maintain communication with:
Notaries
External legal counsel
Government regulators
BPJS Kesehatan and insurance companies
Assist in resolving legal issues or obstacle during pre-operational inspections or audits
Ongoing legal monitoring and support post commissioning
Maintain a compliance calendar for license renewals, contract expirations, and regulatory deadlines
Support day-to-day legal operations after the hospital opens, including:
New vendor contract review
Legal review of promotional materials or public communications
Response to legal inquiries and incidents
Legal training and awareness
Provide legal briefings or training for staff on:
Legal documentation procedures
Patient rights and data protection
Consent and confidentiality obligations
Hospital legal protocols
Support for internal audit and accreditation.
Assist in legal document preparation for hospital accreditation
Ensure legal compliance is verifiable and documented for audits and inspections
Selection Criteria
Bachelor’s degree in law from an accredited Indonesin University
Master’s degree or certification in Health Law, Corporate law, or Compliance is an advantage
Minimum 3 years of legal experience preferably in Healthcare or hospital legal department, law firms handling health, corporate or regulatory law
Proven experience in hospital commissioning legal works is a strong plus
Ability to design and delivery legal training for hospital staff on informed consent and patient rights, medical staff licensing and legal obligations, data protection, ethics and compliance policies
Familiarity with hospital accreditation process
Ability to coordinate with regulators, external counsel, notaries and internal departments
