The Complaints Inquiry Counsel is responsible for all matters relating to the legal representation of CPA Alberta’s Complaints Inquiry Committee (CIC). This includes representing the CIC at Discipline Tribunal proceedings, Appeal Tribunal proceedings, Court of Appeal of Alberta proceedings and applications for judicial review relating to CPA Alberta’s disciplinary processes. The secondary role of this position provides support and assistance to internal CPA Alberta departments as directed. This position reports to the Associate General Counsel and Director, Tribunals Office. CPA Alberta has offices in Edmonton and Calgary and provides hybrid Telecommuting opportunities (working from home a maximum of 3 days a week). What You Bring LLB/JD member in good standing with the Law Society of Alberta and licensed to practice law in Alberta with 3-5 years of experience in litigation and administrative law.

Broad legal knowledge with an emphasis on litigation, administrative law, and/or risk management.

Strong advocacy skills, both oral and written.

Ability to act with good judgment, integrity, fairness and courtesy.

High degree of professional ethics and integrity.

Ability to deal with difficult situations and individuals with tact and diplomacy.

Proven organizational and time management skills.

Ability to handle competing tasks and work well under pressure.

Prosecutorial experience as well as experience in the disciplinary process of self-regulating professions is preferred but not essential.

What You Will Be Doing

Advise and work alongside the CIC and Conduct & Discipline (C&D) staff on legal issues relating to complaints and the complaint process.

Advise the CIC on matters of law, including evidence, procedure and applicable principles of administrative law relating to the complaint process.

Manage settlements of discipline referrals under the Chartered Professional Accountants Act (the Act).

Carry out all things necessary for the effective and efficient representation of the CIC in matters before CPA Alberta’s Discipline and Appeal Tribunals as well as the Court of King’s Bench of Alberta and Court of Appeal of Alberta including:

Dealing with investigated parties and defense counsel on issues relating to prosecutions.

Preparing necessary written materials (i.e. letters, briefs, pleadings, exhibit books, etc.).

Determining witnesses that may be required to prosecute files and briefing them to give evidence.

Work with and instructing CPA Alberta’s external counsel in relation as required.

Advise of potential areas for training and support related to the CIC or Tribunals Roster and, working with the DTO/AGC, assist in the development of materials for such training and support.

Assist on a variety of in-house legal and policy matters for CPA Alberta as directed and overseen by the Associate General Counsel and Director, Tribunals Office to provide advice and support to manage organizational risks.
