RECORDS AND PRIVACY OFFICER 1.0 FTE Permanent Position Salary Range: $70,469 to $88,311 per year

The Simcoe County District School Board is seeking qualified applicants for the full-time position of Records and Privacy Officer. This position reports to the Controller and is a member of the Business Services team. The Records and Privacy Officer will be responsible for ensuring compliance with MFIPPA by managing FOI requests, privacy breaches, and records management activities. They also lead privacy impact assessments and provide expert guidance to schools and staff on privacy and records management best practices. Duties

and Accountabilities

: Maintain records retention schedules that comply with legal and regulatory requirements and provide for the destruction of obsolete and transitory records. Analyze and advise on access, privacy and information management practices including access to, use and disclosure of personal information and retention/destruction of recorded information. Develop, implement and deliver staff training programs on access, privacy and information management. Collaborate with department managers to identify vital records and establish a vital records protection and disaster recovery program and procedures. Research, keep informed and disseminate information on legislative changes, Information and Privacy Commission orders, judicial reviews, and Board programs which inform access, privacy and information management practices. Complete Privacy Impact Assessments (PIAs) on any applications (software, websites, etc.) that the board may consider implementing. Process requests for information and any resulting appeals made under the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) and Personal Health Information Protection Act (PHIPA) and advise on release and disclosure in accordance with the Acts. This includes mediating, preparing affidavits and representations as required for appeals. Assess situations and advise Board staff on appropriate use and disclosure of personal information in accordance with legal requirements. Research, review and make recommendations on information that should be made publicly available through active dissemination and routine disclosure to promote openness and transparency in accordance with the Acts. Confer with legal counsel, the Information and Privacy Commission and Management and Government Services as required to ensure Board records provide full and accurate documentation of due diligence in fulfillment of legal and social obligations. Qualifications, Pertinent

Skills,

and Experience: Two (2) year post-secondary education in Information Management, Privacy, and Access, Business, Public Administration, Law, or related discipline. Completion of one or more of the following certifications: Certified Records Analyst, Ontario Association of School Board Officials (OASBO) Privacy and Information Management Certificate, Certified Information Privacy Professional/Canada (CIPP/C). Minimum of five (5) years' experience working directly with the Municipal Freedom of Information and Privacy Act (MFIPPA) or other related access and privacy legislation. Experience in working with external resources that may include lawyers or other professionals/advisors to resolve ongoing privacy issues. Ability to listen, interpret, analyze, assess and clarify questions related to the access, privacy and information sharing practices. Ability to advise and make recommendations in accordance with legal requirements. Excellent verbal and written communication skills. Ability to deal with confidential information including being respectful of the sensitivity of the information. Must be self-directed, have initiative and have excellent organizational skills. Ability to research, assess and disseminate information as required.

This is a permanent position that works twelve (12) months of the year. The compensation range for this twelve (12) month position is $70,469 to $88,311 per year, depending on qualifications and experience. This position is based on a thirty-five (35) hour work week. Participation in the OMERS Pension Plan is mandatory for all full-time permanent employees, even if currently in receipt of an OMERS pension.
