Job Description
A Senior Lawyer will undertake a variety of legal duties in relation to child protection matters. The appointee will be required to deal with referred child protection matters and conduct the resulting child protection proceedings along with undertaking the DCPL's other functions under s9 of the Director of Child Protection Litigation Act 2016 (DCPL Act). You will also engage with a range of stakeholders in the court environment in respect of the delivery of the functions of the DCPL. All positions are located centrally within the Brisbane City CBD. The staff of the office are employed under the Public Sector Act 2022 (see s37 of the Director of Child Protection Litigation Act 2016).
Responsibilities
Deal with referred child protection matters on behalf of the DCPL, including the review of briefs of evidence, preparation and drafting of applications, and settling of affidavits;
Undertake the resulting child protection proceedings on behalf of the DCPL, including appearing as an advocate in appropriate matters at mentions, interim hearings, court ordered conferences and final hearings;
Prepare and apply for the transfer of child protection orders or proceedings to participating states, and personally appear in proceedings;
Provide legal information and advice to the Department of Child Safety, Seniors, Disability Services and Multicultural Affairs (Child Safety) staff in relation to the functions of the chief executive (child safety) under the Adoption Act 2009 and the Child Protection Act 1999, and represent the State in associated legal proceedings in relation to court or tribunal proceedings, including in matters to which the Convention on the Civil Aspects of International Child Abduction applies under the Family Law Act 1975 (Cwlth);
As required, provide advice to the DCPL about the DCPL's functions and powers under s9 of the DCPL Act;
Contribute to the professional development of others in the ODCPL including providing clear guidance, constructive feedback and mentoring regarding the conduct of matters and child protection practices and procedures;
Help maintain networks with a range of relevant stakeholders in the performance of functions of the role;
Ensure all work complies with quality and case management standards and meet all other professional and corporate responsibilities;
A commitment to self-development and maintaining up-to-date knowledge of child protection law and procedure, and participate in and maintain a proactive approach to self-development including achievement of CPD points and participation in performance management; and
As required, participate in the development and provision of continuing professional development to others in the ODCPL.
