Overview of the team The Statutory Oversight team is responsible for providing expert advice on the application of statutory processes to business areas within Comcare and acts as Comcare’s liaison with the Office of the Australian Information Commissioner and the Commonwealth Ombudsman.

Statutory Oversight actively promotes Privacy and develops Comcare-wide privacy training and are responsible for ensuring Privacy Impact Assessments are completed and that Comcare’s activities are consistent with the Privacy Act 1988.

The team is responsible for undertaking all of Comcare’s freedom of information functions as well as receiving Public Interest Disclosures (PID) and coordinating PID investigations. They also facilitate administrative access to personal information under the statutory requirements in the Safety, Rehabilitation and Compensation Act 1988 (SRC Act).

The Privacy Reform unit, within the Statutory Oversight team is primarily responsible for preparing an assessment to ensure Comcare’s compliance with the Privacy Act. This will be achieved through the Privacy Act Reform (Assessment Stage) project which will conclude at the end of June 2026.

The purpose of this project is to work with business areas to assess what compliance changes are necessary, including what does not need to change, before Comcare commences implementation or making decisions about technology, system or process changes with respect to management of personal information. It is anticipated that findings and requirements identified through the assessment phase will be implemented by a future phase.

Overview of the role The Legal Adviser, Privacy Reform supports the Principal Legal Adviser/Director Privacy Reform and Senior Legal Adviser, Privacy Reform and helps support other members of the project team to provide client-focused high level, specialist legal and strategic advice and support to Comcare staff to ensure compliance with statutory obligations.

This role will achieve organisational objectives through successful planning and participating, contributing and collaborating across Comcare with stakeholders as part of the Privacy Act Reform (Assessment Stage) project.

The Legal Adviser, Privacy Reform will resolve problems, manage risk effectively and manage their own workload in a manner consistent with the APS Values and Code of Conduct, the Legal Services Directions 2017, and internal Comcare procedures.

Mandatory qualifications and experience

Undergraduate degree in law

Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory (two years or more post admission experience is desirable)

Current Practising Certificate or ability to obtain one within three months of commencement

Eligibility and specific conditions of employment

Australian citizenship

Character clearance (Australian Criminal History Check)

Employee health declaration

Six months probationary period for new engagements
